A SAPCR is a Suit Affecting the Parent Child Relationship.  If there are children involved in a divorce proceeding between the mother and father then the child custody and child support must be addressed in the SAPCR divorce.

Figuring out who the children should live with is based on the principle of what is in the best interest of the children.  Things such as safety and the ability to make sure that the children’s educational and environmental needs are met will be addressed.  The Texas Family Code prohibits the judge from discriminating who the children will live with based solely on the gender of the parent.  Fathers have the same rights under that section of the Family Code as mothers do.
